EVERYTHING PROPERTY PERTH TERMS AND CONDITIONS
Effective Date: 02/04/2025
Terms and Conditions – Everything Property Perth
These Terms and Conditions (“Agreement”) apply to all services provided by RNG Solutions Pty Ltd, trading as Everything Property Perth (“we”, “us”, “our”).
By accepting a quote or engaging our services, the Customer acknowledges and agrees to the following terms.
1. Services Provided
We provide ceiling and wall repairs, gyprock installation, plastering, cornice installation, patchwork, and associated finishing services.
Work is performed to industry standards and in line with Western Australian building practices.
2. Use of Subcontractors
Where required, we may engage qualified subcontractors to assist with the work.
All subcontractors operate under our direction and must meet our workmanship standards.
The Customer agrees not to engage our subcontractors directly for a period of 6 months after work completion, unless approved by us in writing.
3. Quotes, Pricing and Variations
-
All quotes are based on the information available at the time of quoting.
-
If additional issues are discovered (e.g., water damage, unsafe framing, asbestos, access limitations), a variation may be required.
-
Variations will be discussed with the Customer before proceeding.
-
Quotes are valid for 30 days unless otherwise noted.
4. Deposit and Payment Terms
-
A deposit of 20% may be required to secure bookings or materials.
-
The balance is due upon completion, or within 7 days for approved builders or property managers.
-
Late payments may incur a reasonable late fee to cover administrative costs.
-
Payments may be made via bank transfer or other approved methods.
5. Debt Recovery
If payment is not received within the agreed timeframe:
-
We may engage a debt collection service.
-
The Customer is responsible for any reasonable costs associated with recovery.
Materials supplied by us remain our property until full payment is received.
6. Workmanship Warranty & Rectification
We provide a 12-month workmanship warranty, consistent with WA standards.
This warranty covers defects arising from our work but does not cover:
-
Movement caused by the home’s structure (e.g., ceiling joist movement, bowed timber, truss uplift)
-
Pre-existing conditions not created by us
-
Damage caused after we leave site
-
Glancing light imperfections (see Section 7)
-
Cracks caused by building movement or moisture changes
We will attend to valid warranty issues within a reasonable timeframe.
7. Surface Expectations, Glancing Light & Pre-Existing Conditions
Plasterboard surfaces are affected by lighting, framing, and the age of the home. Customers acknowledge:
Glancing Light
Strong natural or artificial light may highlight minor surface imperfections that are not visible under normal lighting.
This phenomenon is widely recognised in AS/NZS 2589:2017 for plasterboard finishing and is not considered a defect.
Framing Irregularities
Uneven or bowed framing may cause:
-
uneven ceilings
-
visible waves
-
cornice gaps
-
inconsistent shadow lines
These are structural issues and are outside our control.
Existing Walls & Trims
Old, out-of-square, or uneven walls may result in:
-
trims not sitting perfectly flush
-
small gaps
-
variations in reveal or shadow lines
We will make reasonable adjustments, but such imperfections are common and not workmanship defects.
Level of Finish
Unless otherwise agreed in writing, all work is completed to a Level 4 finish, suitable for standard residential painting.
8. Customer Responsibilities
The Customer agrees to:
-
Provide clear access to the work area
-
Ensure pets and children are kept away from work zones
-
Protect furniture and belongings (we take reasonable care but are not liable for unprotected items)
-
Notify us of any known hazards, including asbestos, electrical issues, or leaks
If access or safety issues delay the job, additional charges may apply.
9. Limitation of Liability
We accept liability for:
-
Defects directly caused by our workmanship
-
Materials supplied by us that are defective
We are not liable for:
-
Indirect or consequential loss
-
Delays caused by weather, supply shortages, or third parties
-
Structural issues or movement beyond our control
-
Damage resulting from pre-existing conditions
10. Dispute Resolution
If concerns arise:
-
The Customer must notify us in writing.
-
We will inspect and attempt to resolve the issue promptly.
-
If unresolved, both parties agree to mediation in Western Australia before pursuing legal action.
11. Reviews and Feedback
If issues occur, we ask the Customer to give us the opportunity to resolve them before publishing public feedback.
This is to ensure fairness and accuracy.
This clause does not restrict the Customer’s consumer rights under Australian law.
12. Personal Information & Privacy
Personal information is collected only for quoting, scheduling, and completing work.
We do not sell or share personal information with third parties except as required for debt recovery or legal obligations.
Cookies may be used on our website.
See our Privacy Policy for details.
13. Photographs of Work
We may take before-and-after photos for documentation and marketing purposes.
If the Customer prefers no photos, they must notify us in writing prior to work commencing.
14. Force Majeure
We are not responsible for delays or failure to complete work due to circumstances beyond our control, including weather, supply delays, illness, emergencies, or other unforeseen events.
15. Termination
Either party may terminate the agreement if a material breach occurs.
If the Customer cancels after work has begun, payment is required for all completed work up to the cancellation date.
16. Acceptance
By accepting a quote, paying a deposit, or engaging our services, the Customer agrees to these Terms and Conditions.
