EVERYTHING PROPERTY PERTH TERMS AND CONDITIONS

1. Introduction

These Terms and Conditions (the “Agreement”) govern the use of services provided by RNG SOLUTIONS PTY LTD, trading as Everything Property Perth (“we,” “us,” or “our”). By engaging our services, you (the “Customer”) agree to these Terms and Conditions in full. Please read them carefully.

2. Services Provided

We offer the following services:

  • Carpentry
  • Tiling
  • Demolition
  • Roof Repairs
  • Plastering
  • Painting

3. Subcontractors

We reserve the right to engage subcontractors at our discretion to perform work related to the services we provide. All subcontractors will be chosen based on their skills and qualifications, ensuring they meet the required standards for the job. Subcontractors are considered part of our team, and the Customer agrees that any subcontractors used are integral to the completion of the work.

4. Subcontractor Non-Solicitation

The Customer agrees that they shall not, directly or indirectly, hire or contract with any subcontractor used by RNG SOLUTIONS PTY LTD for the specific project for a period of six (6) months following the completion of the work. In the event of a breach of this clause, the Customer agrees to pay a liquidated damage fee of $10,000, to compensate for the loss of subcontractor services.

5. Payment Terms

  • A deposit of 20% of the total project price is required upon signing the contract.
  • The remaining balance is due within 14 days of project completion or as otherwise agreed in writing.
  • Payments must be made by bank transfer, credit card, or other methods approved by us.
  • Late payments may incur an interest fee of 2.5% per month on the outstanding balance.

6. Debt Collection and Repossession of Materials

  • If any payment is overdue, we reserve the right to engage a debt collection agency to recover the outstanding balance. The Customer will be responsible for any additional costs, including but not limited to, collection agency fees, legal costs, and all other expenses incurred in recovering the overdue amount.
  • In the event of non-payment, RNG Solutions Pty Ltd (trading as Everything Property Perth) reserves the right to repossess any materials or property supplied for the project until full payment is received, provided such repossession is legally permissible under the laws of Western Australia.
  • Repossession rights will be enforced only after prior written notice to the Customer, and we will make reasonable attempts to resolve the matter amicably before proceeding with repossession.

7. Defects and Rectification

In accordance with Western Australian consumer laws and the Australian Consumer Law (ACL), we will rectify any issues arising from defects in workmanship or materials provided by us within 12 months of the completion of the project. We will attend to and correct the defects within a reasonable period after notification from the Customer. This rectification commitment excludes damage caused by external factors such as wear and tear, accidents, misuse, or negligence by the Customer or third parties.

8. Limitation of Liability

  • Direct Liability: RNG SOLUTIONS PTY LTD is liable for any direct damage resulting from faulty workmanship or materials provided by us.
  • Indirect Liability: RNG SOLUTIONS PTY LTD will not be held responsible for any indirect or consequential damages, including loss of income, damage to other property, or costs associated with delays caused by circumstances beyond our control.

9. Dispute Resolution

Any disputes arising from this Agreement will be resolved in the following manner:

  • Step 1: The Customer must contact RNG SOLUTIONS PTY LTD in writing within 10 business days of the issue arising to allow us to investigate and attempt resolution.
  • Step 2: If the issue remains unresolved after 10 business days, both parties agree to engage in mediation through a qualified mediator in Western Australia, selected jointly by both parties.
  • Step 3: If the mediation process does not result in a resolution, either party may proceed to arbitration or seek legal remedies available under the law.

10. Negative Reviews

We value our reputation and strive to provide excellent service. If the Customer has concerns about our work, we request that they notify us in writing to allow us the opportunity to address and rectify the situation. The Customer agrees to refrain from posting any negative or defamatory reviews about our business online without first giving us an opportunity to resolve the issue. Any review that violates this clause may result in legal action to protect our business reputation.

11. Collection of Personal Information & Cookies

By using our services, you agree to the collection of personal information necessary for the completion of the project. We may collect and store personal details, including your name, contact information, and address, as required for our business operations.

12. Photographs of Work

We may take photographs of the work completed at your property for marketing and portfolio purposes. By engaging our services, you consent to the use of these photographs, unless you request in writing that photos not be taken.

13. Force Majeure

We will not be held responsible for delays or failure to perform the work due to circumstances beyond our control, including but not limited to:

  • Weather conditions
  • Material shortages
  • Supply chain disruptions
  • Acts of God, fire, flood, or other emergencies

14. Termination

Either party may terminate the Agreement in writing if there is a material breach of the terms. If the Customer terminates the Agreement before the completion of the work, they will be required to pay for all work performed up to the termination date.

15. Governing Law

These Terms and Conditions are governed by the laws of Western Australia. Any legal actions arising from or related to this Agreement will be brought before a court of competent jurisdiction in Western Australia.

16. Acceptance

By requesting a quote, signing the contract, or engaging our services, the Customer agrees to be bound by these Terms and Conditions.
